Welcome to VizCon (the “Service”), owned and operated by MKSolutions (the “Company,” “we,” “us,” or “our”). MKSolutions is a French company registered under SIREN 908 831 308 with VAT number FR88908831308, located at 26 rue du chapeau rouge, 69009 Lyon, France. By accessing or using VizCon, you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (the “Agreement”). If you do not agree with any of these terms, please do not use the Service.

2. Service Description

VizCon is an AWS infrastructure visualization and auditing tool that:

  • Generates diagrams of AWS resources (VPCs, subnets, route tables, security groups, etc.).
  • Performs on-demand checks for potential misconfigurations or excessive permissions.
  • Supports multi-account and multi-region AWS environments, providing a holistic view of your infrastructure.

3. Eligibility

1. You must be at least 18 years old (or the age of majority in your jurisdiction).

2. You must have the legal capacity to form a binding contract under applicable laws.

4. Payment and One-Time Purchase

1. One-Time Fee: VizCon is offered under a one-time purchase model (“Lifetime Access”), with no recurring subscription fees.

2. Payment Processing: All payments are handled through Stripe. By completing a transaction, you agree to abide by Stripe’s terms of service and any related policies.

3. Refund Policy: We offer a full refund within 30 days of purchase. To request a refund, please contact us at contact@mksolutions.fr with your order details. Refunds after 30 days are not provided unless otherwise required by law.

5. Connecting to AWS Environments

1. Connection Methods: VizCon can connect to your AWS environment using any of the following methods:

  • Read-Only Role (Recommended): You create a restricted IAM role granting VizCon minimal permissions.
  • User Credentials: You provide AWS user access keys and secrets.
  • Temporary Credentials: You supply short-term session tokens.

2. User Responsibility:

  • You are responsible for configuring these credentials or roles securely, adhering to the principle of least privilege.
  • If you choose to provide user credentials or temporary tokens, it must comply with AWS best practices and your internal security guidelines.

3. Data Handling:

  • We do not store your AWS credentials beyond what is necessary for VizCon’s functionality.
  • The read-only IAM role method is strongly recommended to minimize potential security risks.

6. Account Setup and Usage

1. Updates: VizCon may be updated with new features or fixes. All updates are included in your one-time purchase unless otherwise noted.

2. Acceptable Use:

  • You agree not to use VizCon to violate AWS terms, French or international laws, or any third-party rights.
  • Attempting to reverse engineer or copy the VizCon software is strictly prohibited.

7. Intellectual Property

1. Ownership: All intellectual property rights to VizCon are owned by MKSolutions.

2. License: Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable license to use VizCon for internal business purposes.

8. Data Protection and Privacy

1. Minimal Data Storage: VizCon only stores the resource metadata (e.g., IDs, names, configurations) required to generate diagrams or run audits.

2. Confidential Information: We encourage using the read-only IAM role to minimize any disclosure of confidential AWS information.

3. Privacy Policy: Refer to our [Privacy Policy] for information on how we handle personal data and resource details.

9. Disclaimer of Warranties

VizCon is provided “as is,” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by applicable law, MKSolutions, its affiliates, or suppliers shall not be liable for any direct, indirect, incidental, consequential, or special damages (including but not limited to loss of data, profit, or business) arising out of or in connection with the use or inability to use VizCon.

11. Indemnification

You agree to indemnify, defend, and hold harmless MKSolutions and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of VizCon or your violation of these Terms.

12. Termination

1. By You: You may stop using VizCon at any time. If you choose to discontinue usage more than 30 days after purchase, no refund will be provided.

2. By Us: We may suspend or terminate your access if you violate these Terms or engage in unlawful or objectionable conduct.

3. Effect of Termination: Upon termination, your license to use VizCon ceases immediately.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Lyon, France, unless otherwise stipulated by mandatory legal provisions.

14. Modifications to Terms

We may revise these Terms at any time. If significant changes occur, we will notify you by email or via our website. Your continued use of VizCon after such notice indicates acceptance of the revised Terms.
